Employers Must Post Time Off to Vote Notice

With the approaching November 8 election, we want to remind employers that they must post the Time Off to Vote Notice by Friday, October 28. The California Elections Code requires employers to post a notice to employees informing them of state law provisions for taking paid leave to vote in statewide elections. Employers must post the notice at least 10 days before a statewide election, either in the workplace or in a location where employees can see it as they enter or exit their place of work.

The notice reviews the basic voting time rights for employees, which include the following:

  • Employees are eligible for paid time off for the purpose of voting only if they do not have sufficient time outside of working hours to vote;
  • Employees may take as much time as they need, but they’ll be paid for a maximum of two hours;
  • An employer may require employees to give advance notice that they will need to take time off for voting;
  • An employer may require employees to take this time off at the beginning or end of their shift.
