CA Labor Commissioner Launches Online Violation Reporting System

The California Department of Industrial Relations (“DLSE” or “Labor Commissioner”) has launched an online reporting site allowing individuals to submit “real time leads” on “businesses that are breaking labor laws.”

The system allows anyone, whether an employee or not, to report alleged labor law violations directly to the DLSE. This augments the agency’s existing online claim process.

The online reporting site is rife with potential problems and, despite the agency’s good intentions, is easily abused. Employers can expect that DLSE audits and investigations will increase, potentially as a result of multiple reports by a single person or individuals using pseudonyms.

The DLSE announcement discussing its new system can be seen here. Its wage theft site, which directs individuals to report violations or file claims on their own behalf, can be seen here.
