US DOL Active with Migrant and Seasonal Ag Worker Inspections – North Coast Vineyards Targeted

We were just notified by the California Farm Labor Contractor Association (CalFLCA) that compliance inspectors from the US Dept. of Labor have been active in the Napa and Sonoma area, conducting inspections and writing violations on a range of Migrant and Seasonal Agricultural Worker Protection Act (MSPA) requirements. Their focus is Worker Transportation, Worker Housing, and Worker Notification on Terms & Conditions of employment (WH 516).

One of the CalFLCA members indicated they were selected for inspection earlier this week based on a state registry for employers providing housing. Another was inspected last week when DOL officers spotted a large 15 passenger van used to transport workers, though any van transporting workers in Napa-Sonoma is likely to create a target for inspectors.

DOL inspectors also strongly consider fines for the grower as a joint employer, along with any FLC/Vineyard Management Company found in violation of MSPA requirements.
