New Farm Labor Contractor Reporting Requirements

New labor law AB 243 (Chapter 671, Statutes of 2011) effective January 1, 2012 amends Labor Code section 226 and includes language specific to Farm Labor Contractors. Any employer that provides labor on someone else's agricultural land is required to report on every employees’ pay statement (paystub) the name and address of the legal entity that secured the services of the employer during that pay period and all applicable hourly rates in effect during the pay period and the corresponding number of hours worked at each hourly rate by the employee.

The new rules in Labor Code 226 says that for every violation employers will be fined $50 per employee for the first violation (pay period), $100 per employee for every subsequent violation up to $4000 per employee.
